Terms of Service
1. Introduction
These terms apply when you download, install, or use the Small Hours Baby Sleep Tracker mobile app ("the app"). By using the app, you agree to these terms. If you do not agree, do not use the app.
2. About us
The app is made and run by Hyung-shik Jung, an independent developer in the Republic of Korea ("we", "us"). You can contact us at support@small-hours.app.
3. Changes to these terms
We may change these terms. We will post the new version here, and we may also tell you in the app. If you continue to use the app after a change, the new terms apply.
4. Eligibility
You must be an adult under the law where you live (19 or older in the Republic of Korea) to use the app. If you are younger, you may use it only with the consent of a parent or guardian.
5. Use in other countries
Do not use the app where its use is illegal. If you use the app outside the Republic of Korea, you must obey the local laws that apply to you.
6. What you need
You need a compatible iPhone, an internet connection for sign-in and sharing, and any mobile data plan. You pay for these yourself.
7. Acceptable use
Do not use the app to:
- break the law, cheat, or harm other people;
- harass or abuse the caregivers you share with;
- infringe anyone's rights;
- upload malware, or try to break into, overload, or disrupt our systems;
- access other people's data without permission; or
- collect data from the app with automated tools, or use it to train machine-learning models.
8. Licence and restrictions
We give you a limited, personal, non-exclusive, revocable licence to use the app on devices you own or control. You may not copy, change, reverse engineer, distribute, sell, rent, or sublicense the app, or use it to build a competing product. The only exception is where the law allows it and you cannot waive that right.
9. Your content
You own the records, notes, and photos you add ("your content"). You give us permission to store, copy, and transmit your content only as needed to run the app, for example to sync it with the caregivers you invite. You confirm that you have the right to add your content. We may remove content that is illegal or that breaks these terms.
10. Health disclaimer
The app helps you record and look back on your baby's care. It does not give medical advice, and it does not diagnose or treat any condition. Summaries, charts, and reminders are for information only. Always ask a doctor or other qualified health professional about your baby's health. In an emergency, call your local emergency number (119 in Korea) at once.
11. Availability and updates
We try to keep the app working, but we cannot promise that it will always be available or free of errors. We may change, suspend, or stop features. Updates may install automatically, depending on your device settings. Keep your own copies of important information.
12. Account security
You are responsible for keeping your sign-in and your device secure: your Apple or Google account, or the email address and password you use with the app. Share invite codes only with people you trust. We may suspend access if we suspect misuse or a security problem.
13. Apple and other platform operators
These terms are between you and us only, not Apple. Apple is not responsible for the app or its content, and has no obligation to provide maintenance or support. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them. Apple's Licensed Application End User License Agreement also applies, where it does not conflict with these terms.
14. Data protection
We handle personal data as described in our Privacy Policy, the Korean Personal Information Protection Act, and other data protection laws that apply to you.
15. Third-party services
The app uses or links to services from other companies, such as Apple, Google, Supabase, and Superwall. Their own terms apply, and we are not responsible for them.
16. Intellectual property
We or our licensors own all rights in the app, including its design, artwork, and code. The fonts included in the app are used under their own open licences.
17. Limitation of liability
The app is provided "as is" and "as available". As far as the law allows, we are not liable for indirect or consequential loss, or for loss of data. Our total liability to you is limited to the greater of the amount you paid us in the 12 months before the claim and KRW 200,000. Nothing in these terms limits liability that cannot be limited by law, such as liability for intent or gross negligence, or your rights as a consumer.
18. Your promises
You promise that you will obey these terms and the law, and that your content does not infringe anyone's rights.
19. Indemnity
As far as the law allows, you will compensate us for losses caused by your breach of these terms or your misuse of the app.
20. Termination
You can stop using the app at any time and delete it. We may suspend or end your access if you break these terms. When access ends, your licence to use the app ends too.
21. Severability
If a court finds that part of these terms is invalid, that part is removed and the rest stays in force.
22. Assignment
You may not transfer your rights under these terms. We may transfer ours, for example if the app is sold, and we will tell you if the law requires it.
23. Subscriptions, purchases, and refunds
- Some features need a paid subscription. Purchases are made through the Apple App Store and are subject to Apple's terms. We do not handle your payment details.
- Subscriptions renew automatically unless you turn off auto-renewal at least 24 hours before the current period ends. You can manage or cancel a subscription in your Apple Account settings.
- If a subscription includes a free trial, it becomes a paid subscription at the end of the trial unless you cancel before then.
- If you cancel, you keep paid features until the end of the current billing period.
- Apple handles refunds. You can ask for one at reportaproblem.apple.com.
- Prices can change. If a price goes up, Apple will tell you before the change applies.
24. Governing law and jurisdiction
These terms are governed by the laws of the Republic of Korea. Disputes go to the Seoul Central District Court as the court of first instance, unless the law gives you the right to use another court. If you are a consumer in another country, you keep any protections that your local law gives you.
